The Legitimate Government in Hawaii Series: Breaches of Neutrality and Not War Status
Review by Amelia Gora (2021)
The breaches of Neutrality laws are documented and Not War Status claimed by those not friendly to the Kingdom of Hawaii/ Hawaiian Kingdom.
In 1893, the planned, premeditated move to assume a neutral, friendly, non-violent nation was made by conspirators, treasonous persons, pirates, pillagers, racketeers and called themselves the Provisional government.
They were mostly attorneys who utilized, manipulated terminologies to enrichen themselves.
Examples are Charles Reed Bishop, Alfred S. Hartwell, Sanford B. Dole, Lorrin Thurston, Sereno Bishop, William O. Smith, et. als.
If you notice in history books, the move away from the neutrality laws, the Proclamations, etc. and claimed that Queen Liliuokalani was breaking the Constitution that they had forced King David Kalakaua to sign in 1878 which Queen Liliuokalani called the Bayonet Constitution.
Actually King Kalakaua had guns to his head and forced to sign which stripped him of his Sovereign authority.
Let's focus on U.S. President Grover Cleveland's Proclamation reminding Americans of the Neutrality breaches would mean the takeover could be a "Military expedition or enterprise."
So, the use of the Military does not make it a War in the case of the usurpation of the Queen in 1893, but a Neutrality breach against a neutral, friendly, non-violent nation.
The following article shows that U.S. President Grover Cleveland warned Americans of the Neutral Nation status of the Hawaiian Kingdom/Kingdom of Hawaii:
1896 - August 26. U.S. President Cleveland: Warned About a Military enterprise or Expedition = Breach of Neutrality
Let's Review What Happened in 1854 during Kamehameha III - Kauikeaouli's reign:
1854 - Proclamation of Neutrality was made with penalties of being treated as Pirates:
Proclamation of Neutrality Served to Other Nations:
SUMMARY
Kamehameha III - Kauikeaouli took care of his people and passed Proclamations to protect the lives, safety, health of his people.
He passed the Mahele in 1848 and in 1851 assured that his people would have Allodial titles forever properties to be passed on to kanaka maoli to their descendants forever and ever their mineral, water rights, and free from taxes.
In 1849 the permanent friendship and amity treaty was made with the United States. It was ratified in 1850 by Kamehameha III - Kauikeaouli.
Note: Article XIV of the Treaty documents pirates, pillagers, etc. and the penalties made for those who were guilty and would be treated as pirate, etc.
Kamehameha III - Kauikeaouli was not feeling well since 1853, he made a Proclamation that his adopted son Alexander Liholiho would be his successor, then he passed the Neutrality Proclamation and made sure it was served to other nations.
He died in 1854.
The Neutrality status continued on.
U.S. President Grover Cleveland respected the Neutrality laws, but U.S. President William McKinley and all the U.S. Presidents Failed to recognize the Neutrality laws.
U.S. President Grover Cleveland did give Hawaii Back to Queen Liliuokalani in 1893, 1894, and 1897.
United Nations Dr. Alfred deZayas recognized the fact that the Kingdom of Hawaii/Hawaiian Kingdom still exists, and the U.S. has to follow the laws of the occupied nation and not their laws.
In reviewing the status of the Provisional government, the Republic of Hawaii, and the Territory of the United States turned to Territory of Hawaii shows that at no time did they or could they have sovereignty.
Opposition was made to Statehood by Kamehameha's descendant Mele Keawe Kauweloa supporting Harold Abel Cathcart, which means that the Statehood claim by a nation that supported the usurpers have breached the Neutrality laws.
Once again, the whole affair is Not a War Status but a breach of Neutrality laws.
Note: The 1849-1850 Treaty of the Kingdom of Hawaii/Hawaiian Kingdom is aligned to the U.S. Constitution of 1787. Article 6 states that the Treaties are the Supreme Law of the Land and Judges are to also abide by the treaties.
In 1899, the United States under U.S. President William McKinley became two (2) nations: (1) American Empire - territories under this with no treaties; (2) United States - dealt with nations which had treaties.
By creating a Territory of the United States under the American Empire, there was no treaties.
Violations of the U.S. Constitution of 1787 was made, breach against the Treaty of 1849-50 which is and remains a permanent treaty of amity, and friendship; breaches against the Neutrality laws which was served to the U.S. and other nations in 1854.
For the Legal records, this is evidence of the Neutrality laws which remain in place.
Research incomplete.
